PROFESSIONAL MARITIME TITLE OF QUALIFICATION FOR THE COMMAND OF RECREATIONAL CRAFTS ENGAGED IN COMMERCIAL ACTIVITIES (COMMERCIAL YACHTS)
Pleasure yachts in commercial use (engaged in trade) shall comply at all times with the 1978 International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, as amended (STCW 78/95). San Marino DELEGATED DECREE No. 104 of 9 August 2024 establishes minimum standards for a Certificate of Competency (CoC) for Yacht Masters and Navigational Officers employed on coastal navigation, up to 60 nautical miles from a sheltered place. This limited coastal CoC follows the principles of the STCW 78/95 convention and has been notified to the General Secretariat of the IMO, in accordance with the related procedure. Recreational crafts used for commercial purposes, used for the transport of up to 12 passengers, may be skippered by Masters holding Certificates of Competence in accordance with the requirements set out in San Marino DELEGATED DECREE No. 104 of 9 August 2024 for qualifications to operate commercial yachts not exceeding 24 meters in length and 200 GT or for qualifications to operate commercial yachts of 24 meters or more and less than 500 GT). The Certificate of Competence as Commercial Yacht Master, is issued according to the criteria of the International Convention STCW 78/95, as amended, as a Certificate equivalent to the Certificate of Competence for Masters qualified for navigation in coastal voyages in line with the principles of Article IX and Regulation II/3 of the Convention. Such Certificate is issued, on the form provided for within the STCW Convention, by the San Marino Maritime Navigation Authority and is notified to the IMO, pursuant to Article IX, paragraph 2 of the STCW Convention. Requirements for obtaining a Commercial Yacht Master CoC are defined by Art. 76-quinquies of San Marino DELEGATED DECREE No. 104 of 9 August 2024 .
Lastly, REGULATION N. 6 OF 16TH FEBRUARY 2024 establish minimum requirements for entities interested in providing education and professional training in order to obtain THE CERTIFICATES OF COMPETENCE (COC) in compliance with THE INTERNATIONAL STCW CONVENTION 78/95 AND WITH LAW NO. 120 OF 2 AUGUST 2019 AS AMENDED.
